These Terms of Service (“Terms”) govern your use of Edmonton Spotlight (“Service”, “Platform”), operated by Lumin Marketing Group (“we”, “us”, “our”), based in Edmonton, Alberta, Canada.
By accessing or using Edmonton Spotlight, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Description of Service
Edmonton Spotlight is an online platform that connects local businesses with customers in the Edmonton area. We provide:
- Free business listings — basic directory presence for any Edmonton business
- Premium listings — enhanced features including analytics, priority placement, and photo galleries
- Ultimate plan — full-service package including CRM, AI tools, and dedicated onboarding
- Events listings — local event promotion and discovery
- Business search and discovery — helping customers find local businesses
2. Eligibility
You must be at least 18 years of age to use this Service. By using Edmonton Spotlight, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.
3. User Accounts
To claim or manage a business listing, you must create an account. You agree to:
- Provide accurate, current, and complete registration information
- Maintain the security and confidentiality of your password
- Accept responsibility for all activities that occur under your account
- Notify us immediately at support@edmontonspotlight.ca of any unauthorized access or security breach
- Not share your account credentials with third parties
We reserve the right to disable any account that we reasonably believe violates these Terms.
4. Business Listings
Claiming a Business
By claiming a business listing, you represent and warrant that:
- You are an authorized representative of the business (owner, manager, or designated agent)
- All information provided is accurate, current, and not misleading
- The business operates legally in its stated jurisdiction
- You have the right to share the business's contact information and photos
Listing Content
You are responsible for keeping your listing information up to date. We may:
- Edit or supplement listing information for accuracy or formatting
- Display publicly available business information (address, phone, hours) regardless of claim status
- Remove or modify listings that violate these Terms
- Feature listings in search results, category pages, and promotional materials
Unclaimed Listings
We may create listings for businesses using publicly available information. These listings are provided as a public service. Business owners can claim their listing at any time to take control of their profile.
5. Prohibited Content & Conduct
You may not use the Service to:
- Post content that is false, misleading, defamatory, or deceptive
- Infringe on any intellectual property rights, trademarks, or copyrights
- Upload illegal, harmful, threatening, abusive, or offensive material
- Promote illegal activities, services, or products
- Impersonate another person or business
- Claim a business you are not authorized to represent
- Scrape, crawl, or harvest data from the platform without written permission
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or its infrastructure
- Use automated systems to inflate views, clicks, or other metrics
- Violate any applicable Canadian federal, provincial, or municipal law
We reserve the right to remove any content and suspend or terminate accounts that violate these provisions, without prior notice.
6. Payment Terms
Subscriptions
- Premium and Ultimate plans are billed on a recurring monthly or annual basis
- All prices are in Canadian Dollars (CAD) and include applicable taxes
- Payments are processed securely through Stripe — we never store your credit card information
- Subscriptions automatically renew unless cancelled before the next billing date
Free Trials
- We may offer free trial periods for paid plans at our discretion
- No credit card is required for trial activation
- At the end of a trial, your plan reverts to free unless you subscribe
- Trial features may be limited compared to paid subscriptions
Cancellation & Refunds
- You may cancel your subscription at any time through your dashboard or by contacting us
- Cancellation takes effect at the end of the current billing period — you retain access until then
- Refunds are issued at our discretion; contact support@edmontonspotlight.ca within 14 days of a charge to request a refund
- We may issue prorated refunds for annual subscriptions cancelled within 30 days
7. Intellectual Property
The Edmonton Spotlight name, logo, design, and all original content created by us are the property of Lumin Marketing Group. You may not use our branding without written permission.
By uploading content (photos, descriptions, logos) to your listing, you grant us a non-exclusive, royalty-free license to display that content on the platform and in promotional materials related to the Service. You retain ownership of your content and may remove it at any time.
8. Contact Forms & Messaging
Our platform allows customers to send messages to business owners through contact forms. By using these forms:
- Senders agree that their name, email, and message will be shared with the business owner
- Business owners agree to handle received contact information in accordance with applicable privacy laws
- We are not responsible for the content of messages between users and businesses
- We reserve the right to monitor messages for abuse prevention purposes
9. Third-Party Services
Our Ultimate plan includes access to third-party tools (CRM, AI chatbot, voice AI) provided through GoHighLevel. Use of these tools is subject to their own terms of service. We are not responsible for the availability, performance, or policies of third-party services.
Business listings may contain links to external websites. We do not endorse or assume responsibility for the content or practices of linked websites.
10. Electronic Communications (CASL)
In compliance with Canada's Anti-Spam Legislation (CASL):
- We will only send commercial electronic messages with your consent
- Transactional emails (account setup, claim verification, billing) do not require consent under CASL
- Marketing and promotional emails include an unsubscribe mechanism
- Unsubscribe requests are processed within 10 business days
- You may unsubscribe at any time via the link in any email or at edmontonspotlight.ca/unsubscribe
11. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that:
- The Service will be uninterrupted, secure, or error-free
- Business listing information is accurate, complete, or current
- Results obtained from the Service will be reliable
- Any errors in the Service will be corrected
12. Limitation of Liability
To the maximum extent permitted by Canadian law, Lumin Marketing Group, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:
- Your use of or inability to use the Service
- Any content posted on the platform by users or businesses
- Unauthorized access to your account or data
- Interruption or cessation of the Service
- Any transactions between you and businesses found through the Service
Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100 CAD, whichever is greater.
13. Indemnification
You agree to indemnify and hold harmless Lumin Marketing Group from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Content you post or submit through the Service
- Your violation of any third-party rights
14. Governing Law & Disputes
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any disputes arising from these Terms or the Service shall be resolved through the courts of Alberta, Canada. Before initiating legal proceedings, you agree to first attempt to resolve the dispute informally by contacting us at support@edmontonspotlight.ca.
15. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information in compliance with PIPEDA and Alberta's PIPA. By using the Service, you consent to the practices described in the Privacy Policy.
16. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated by:
- Posting the updated Terms on this page with a new revision date
- Sending email notification to registered users for significant changes
Continued use of the Service after changes constitutes acceptance of the updated Terms. If you disagree with the changes, you may close your account.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
